Extension of Stay

Important:

A nationwide injunction has been issued to the elimination of duration of status along with all other changes in the new rule. The information on this page will only be true if the injunction is overturned. This page will remain available until the court case is finalized.

You will need to file for an Extension of Stay (EOS) if you intend to study or train beyond the Admit Until Date (AUD) on your I-94.

All applications for Extension of Stay require you file Form I-539, which must be filed before your AUD.

Reasons for requesting an extension of stay:

How to file

Step 1

You will always require a new Form I-20 from ISS. Do not file for EOS without the correct I-20 for one of the trigger events above. Please review those pages for more information about how to request an I-20.

Step 2

Collect your I-20 funding documentation. All EOS filings for current or future students will require you to submit proof of funding. See this page for more information about funding requirements. This requirement doesn’t apply to those extending for OPT.

Step 3

File your Form I-539 online at my.uscis.gov. ISS cannot help you file your I-539 as it is the student’s responsibility to maintain their status in the US. The advice we can give you will only mimic the information and instructions you can read yourself on the I-539. We strongly encourage you read through the I-539 before asking questions.
