{"id":10698,"date":"2017-06-01T12:11:43","date_gmt":"2017-06-01T12:11:43","guid":{"rendered":"http:\/\/www.uwb.edu\/?p=10698"},"modified":"2024-02-22T18:36:33","modified_gmt":"2024-02-22T18:36:33","slug":"studentconduct","status":"publish","type":"page","link":"https:\/\/www.uwb.edu\/student-affairs\/studentconduct\/studentconduct\/studentconduct","title":{"rendered":"Respondent Rights &amp; Options"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Understanding Your Rights in the Conduct Process<\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-primary-200-color has-text-color\">\n\tAs a respondent, you have a certain rights in the students conduct process, including:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\n\t\tbe accompanied to all proceedings and hearings by an advisor (who may or may not be an attorney);<\/li>\n\n\n\n<li>\n\t\tbe provided notice and an opportunity to be heard prior to the imposition of any disciplinary sanction (if found responsible for violating the Student Conduct Code);<\/li>\n\n\n\n<li>\n\t\tpetition for the disqualification of the Presiding Officer;<\/li>\n\n\n\n<li>\n\t\tprovide a statement, present relevant evidence, and provide witnesses for further consideration by the Presiding Officer during fact finding;<\/li>\n\n\n\n<li>\n\t\tnot be compelled to give self-incriminating evidence;<\/li>\n\n\n\n<li>\n\t\tbe informed of all orders issued in the conduct proceeding;<\/li>\n\n\n\n<li>\n\t\tbe informed if a full hearing is initiated by the Conduct Officer;<\/li>\n\n\n\n<li>\n\t\trequest an agreed settlement to your conduct matter;<\/li>\n\n\n\n<li>\n\t\trequest an administrative review of an Initial Order;<\/li>\n\n\n\n<li>\n\t\tattend all applicable conduct proceedings.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-primary-200-color has-text-color\">\n\tA Brief Overview of the Student Conduct Process<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\n\t\tThe Conduct Officer receives a report alleging a violation of the Student Conduct Code.<\/li>\n\n\n\n<li>\n\t\tA conduct proceeding will be initiated by the Conduct Officer. The fact finding process will focus on gathering all of the pertinent information necessary to determine whether or not a violation of the Student Conduct Code occurred.<\/li>\n\n\n\n<li>\n\t\tAn investigative interview will be scheduled for the respondent to review the alleged violation(s) of the Student Conduct Code and the report with the Conduct Officer.<\/li>\n\n\n\n<li>\n\t\tDuring the investigative interview, the respondent is provided with an overview of the Student Conduct Process and their rights.<\/li>\n\n\n\n<li>\n\t\tThe respondent has the opportunity to provide their account of what occurred, present relevant evidence, and provide names of witnesses for further consideration by the Conduct Officer during the fact finding process.<\/li>\n\n\n\n<li>\n\t\tDuring the fact finding process, the Conduct Officer may initiate a full hearing and the respondent will be notified of this decision. The respondent will then receive further information from the Hearing Officer. (See What to Expect in a Full Hearing brochure for more information.)<\/li>\n\n\n\n<li>\n\t\tAt the conclusion of the fact finding process, the Conduct Officer will make a decision regarding whether there was a violation of the Student Conduct Code based on a \u201cpreponderance pf evidence\u201d standard, and if so, the Conduct Officer will also determine what sanctions are appropriate for the violation(s). This written decision is called an Initial Order.<\/li>\n\n\n\n<li>\n\t\tThe respondent has the option to request an administrative review of the decision within 21 days of service of the Initial Order.<\/li>\n\n\n\n<li>\n\t\tIf an administrative review is not requested the Initial Order is considered final.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-primary-200-color has-text-color\">\n\tGlossary of Terms<\/h3>\n\n\n\n<p>\n\tAdministrative Review: A request made by a respondent seeking review of an Initial Order under certain grounds.<\/p>\n\n\n\n<p>\n\tAdvisor: A person selected to provide support and guidance during the Student Conduct Process.<\/p>\n\n\n\n<p>\n\tAttorney: A person permitted to practice law in Washington State.<\/p>\n\n\n\n<p>\n\tConduct Officer: An individual who has the authority to initiate conduct proceedings under the Code.<\/p>\n\n\n\n<p>\n\tConduct Proceedings: Refers to brief adjudicative proceedings and full adjudicative proceedings.<\/p>\n\n\n\n<p>\n\tFact Finding: The process of collecting information pertinent to the conduct proceeding to determine if there is a violation of the Student Conduct Code.<\/p>\n\n\n\n<p>\n\tFull Hearing: Refers to the hearing that occurs when a matter is designated as being appropriate for a full adjudicative proceeding.<\/p>\n\n\n\n<p>\n\tHearing Officer: A Presiding Officer in a Full Hearing for the purpose of conducting a full adjudicative proceeding.<\/p>\n\n\n\n<p>\n\tInitial Order: Refers to an initial written decision issued in a disciplinary matter by a Presiding Officer.<\/p>\n\n\n\n<p>\n\tInvestigative Interview: A meeting with a Conduct Officer that a respondent is highly encouraged to attend.
