This document describes UW Bothell's guidelines and policies for promoting high standards of academic and behavioral conduct. These standards enable UWB to fulfill its mission of delivering knowledge and experience that is both valuable to the student and valued by society. The UWB community recognizes that when the academic and behavioral conduct of a university is compromised, the quality of the student's education and the value of the degree are also compromised. Therefore, all members of the University community are committed to vigorously upholding the University of Washington Student Conduct Code (WAC 478-120-010-145) and are encouraged to report suspected occurrences of academic dishonesty or behavioral misconduct.
Section 1. Student Conduct Code
The Student Conduct Code is found at http://www.Washington.edu/students/handbook/conduct.html . Every student is held responsible for being knowledgeable about all of the requirements of the UW Student Conduct Code. As an aid to understanding and supporting the Student Conduct Code as it is administered on the Bothell campus of the University of Washington, the following provisions are of particular importance.
WAC 478-120-010 Authority
Pursuant to Chapter 34.05 RCW and the authority granted by RCW 28B.20.130, the Board of Regents of the University of Washington has established regulations on student conduct and student discipline on the University campus.
WAC 478-120-020 Standards of Conduct
1. The University is a public institution having special responsibility for providing instruction in higher education, for advancing knowledge through scholarship and research, and for providing related services to the community. As a center of learning, the University also has the obligation to maintain conditions conducive to freedom of inquiry and expression to the maximum degree compatible with the orderly conduct of its functions. For these purposes, the University is governed by the rules, regulations, procedures, policies, and standards of conduct that safeguard its functions and protect the rights and freedoms of all members of the academic community.
2. Admission to the University carries with it the presumption that students will conduct themselves as responsible members of the academic community. As a condition of enrollment, all students assume responsibility to observe standards of conduct that will contribute to the pursuit of academic goals and to the welfare of the academic community. That responsibility includes, but is not limited to:

WAC 478-120-040 - Disciplinary Sanctions
The following disciplinary sanctions may be imposed for violations of the Student Conduct Code:
1. Disciplinary Warnings and Reprimands - Action may be taken to warn or to reprimand a student for violation of University rules, regulations, procedures, policies, standards of conduct, or orders. Warnings and Reprimands must always be made in writing and shall include a statement that continuation or repetition of the specific conduct or other misconduct will normally result in a more serious disciplinary sanction.
2. Restitution - An individual student is required to make restitution for damage or other loss of property and for injury to persons. Failure to pay, or to make in writing University-approved arrangements to pay, will result in cancellation of the student's registration and will prevent the student from registering with the University.
3. Disciplinary Probation - A student may be placed on disciplinary probation (meaning formal conditions are imposed on a student's continued attendance) for violation of University rules, regulations, procedures, policies, standards of conduct, or orders. The time period and conditions, if any, for disciplinary probation shall be specified. Disciplinary probation serves as a warning to a student that further misconduct will raise the question of suspension or dismissal from the University.
4. Suspension - A student may be suspended from the University for a violation of University rules, regulations, procedures, policies, standards of conduct, or orders. The time period and conditions, if any, for the suspension shall be specified. Suspension serves as a warning to a student that further misconduct will raise the question of dismissal from the University.
5. Dismissal - A student's enrollment in the University may be terminated for violation of University rules, regulations, procedures, policies, standards of conduct, or orders.
6. Forfeiture - In addition to other sanctions, a student who participates in hazing of another shall forfeit any entitlement to state funded grants, scholarships, or awards for a specified period of time.
7. A suspension of dismissal is considered a serious sanction and will be imposed only after the completion of the formal due process review provided in the Student Conduct Code.
Note: If the student is sanctioned for academic misconduct, the UWB instructor will, in most cases, award the penalty of zero credit for the assignment and/or course in question, pending further appeal.
Section C - Definitions of Academic Misconduct
All University of Washington students are expected to conduct themselves as responsible members of the academic community. (WAC 478-120-020(2)) This includes a responsibility to practice "high standards of academic and professional honesty and integrity." WAC 478-120-020(2) (a).
Academic misconduct includes but is not limited to cheating, facilitation, plagiarism, and fabrication in connection with any exam, research, course assignment, or other academic exercise that contributes, in whole or in part, to the satisfaction of requirements for courses or graduation. The following definitions, while not exhaustive, are intended to provide examples of the types of activities that can give rise to a charge of academic misconduct.

Section D- Guidelines for Avoiding Academic Misconduct
The following guidelines are intended to help UWB students make responsible choices involving matters of academic conduct and to help them understand their individual responsibilities and obligations as members of the University community.
1. Be familiar with the Student Code of Conduct, statements, guidelines, and enforcement procedures provided by the University of Washington and UW Bothell. Those who violate University rules regarding academic honesty are subject to disciplinary sanctions, including suspension and dismissal. Ignorance is no defense.
2. Be honest at all times and act respectfully toward others. Do not seek unfair advantage over others by cheating, plagiarizing, fabrication, or facilitation (see "Definitions of Academic Misconduct," Section C).
3. Encourage others to behave fairly and to respect ethical academic conduct. Accept responsibility by refusing to assist in others' misconduct and discouraging others from engaging in misconduct. Recognize that you are authorized to report clear cases of academic misconduct when you have witnessed them.
4. If you are unsure about any part of an assignment, request clarification from the instructor. Failure to understand clear instructions is no excuse for misconduct. When in doubt, always ask!
5. Make safe assumptions about academic honor:
It is your responsibility to understand and follow academic standards for crediting the sources of ideas, information, and phraseology to avoid plagiarizing.
Section E - University of Washington, Bothell, Fair Academic and Behavioral Conduct Process
This section describes the general process applicable to UWB students for enforcing the University's rules, regulations, procedures, policies, standards of conduct, and orders. This section incorporates certain provisions of the General Procedures for Disciplinary Sanctions (WAC 478-120-030) included in the UW Student Conduct Code that are applicable to the procedures at UWB. Students are encouraged to refer to the full text of the UW Student Conduct Code for a full understanding of additional provisions that may apply.
•1. In all situations, whether handled formally or informally, basic standards of fairness will be observed in the determination of:
•a. The truth or falsity of the charges against the student;
•b. Whether the alleged misconduct violates the UW Student Conduct Code; and if so,
•c. The sanctions to be imposed, if any.
The standards for judging student misconduct shall include but not be limited to the standards of conduct as stated in WAC 478-120-020.
•2. Persons who believe that a violation of the Student Conduct Code has been committed should contact the Vice Chancellor for Academic Affairs. The Vice Chancellor has been delegated this authority by the Chancellor of the University of Washington, Bothell. The Vice Chancellor may delegate the authority to initiate disciplinary proceedings to members of his or her staff as well as establish hearing bodies to advise or to act for him or her in disciplinary matters. The person initiating a disciplinary proceeding is referred to as the Initiating Officer.
At UWB, the Vice Chancellor for Academic Affairs will generally appoint a faculty or staff member to serve as the Initiating Officer. The role of the Initiating Officer includes notifying the student accused of misconduct that a disciplinary investigation has been initiated, explaining the nature of the case, detailing how the disciplinary system works, and confirming whether or not the student believes that he or she is innocent of the charges.
If the Vice Chancellor for Academic Affairs identifies a potential or existing exceptional circumstance as defined in WAC 478-120-100 (3)(b)(i), the matter shall be referred directly to the Faculty Appeal Board (see WAC 478-120-100) on the Seattle campus. Exceptional circumstances exist when the sanction of Suspension or Dismissal has been recommended, the student has been charged with hazing, or the sanction of restitution (in excess of three hundred dollars) has been recommended. (Note: The Faculty Appeal Board is made up of faculty members appointed by the Chair of the Faculty Senate in consultation with the Faculty Council on Student Affairs.)
4. Students have the right to appeal any sanction imposed by the Vice Chancellor for Academic Affairs as a result of an informal hearing. The appeal will be to the University Disciplinary Committee in Seattle except when the sanction identifies an existing or potential "exceptional circumstance," in which case the matter shall be referred directly to the Faculty Appeal Board.
5. Any decision of the University Disciplinary Committee may be appealed to the Faculty Appeal Board. All decisions of the University Disciplinary Committee identifying existing or potential "exceptional circumstances" shall be referred directly to the Faculty Appeal Board. In addition, the University Disciplinary Committee may, at any time, in its discretion, refer a matter directly to the Faculty Appeal Board. The Faculty Appeal Board performs distinct functions and, in most cases, conducts an administrative review. In certain cases (defined in WAC 478-120-100(3)), the Faculty Appeal Board conducts a formal hearing.
6. Any decision based on a formal hearing conducted by the Faculty Appeal Board may be appealed to the President of the University or the President's delegate for a final review. All orders of dismissal shall be reviewed by the President or the President's delegate. Orders entered by the President or the President's delegate are final. (See WAC 478-120-125).
7. The President or the President's delegate may take emergency disciplinary action when a student's conduct threatens the health, welfare, or safety of the University or any member of the University community or members thereof. (See WAC 478-120-140).
8. In a case involving an alleged sexual offense, the accuser and the accused are entitled to the same opportunities to have others present during a disciplinary hearing and they shall both be informed of the outcome of such disciplinary proceedings.
9. Any final order resulting from a disciplinary proceeding shall become part of the student's disciplinary record, unless the student is exonerated. (See WAC 478-120-145.)
10. In accord with the Family Educational Rights and Privacy Act, hearings generally will be held in closed session out of respect for the privacy of all students involved. However, the students involved may waive in writing this requirement and request a hearing in open session. (Refer to the UW Student Code of Conduct for more information.)
Step 1: Matters Preliminary to the Filing of a Complaint
1. Faculty or staff who suspect that a violation of the Student Conduct Code has been committed should, in most cases, first attempt to discuss the matter with the student in question. The faculty or staff member should:

In the case of suspected academic misconduct, if no response is obtained from the student by the date indicated by the faculty member, a grade of "0" for that specific assignment may be given by the faculty member. If a response is received from the student that does not resolve the matter to the satisfaction of the faculty member and the processes described below are being followed, a grade of "X" should be issued for the course and will be amended when the process is completed.
3. The faculty or staff member will explain how the student's conduct appears to violate the University of Washington Student Conduct Code (WAC 478-120) and the possible consequences of such a violation as stated in WAC 478-120-040 Disciplinary Sanctions. The faculty or staff member will offer the student the chance to dispute his or her assessment in a discussion with the student. There are three possible outcomes to this initial discussion:
Step 2: Initiating a Complaint
2. If the timing of an incident of alleged academic misconduct is such that the faculty member must submit grades before there is an outcome to the process, the faculty member should assign an "0" for that particular assignment or course grade. The grade may be changed at a later time as or if warranted.
Step 3: Informal Disciplinary Hearings
1. The Vice Chancellor for Academic Affairs or his or her delegate may arrange for an informal hearing with a student accused of misconduct. The purpose of this informal disciplinary hearing is to provide an opportunity for the student to respond to allegations of misconduct before further action is taken. The student waives any rights to an informal hearing by his or her failure to attend. An informal hearing may be configured in one of two ways:
2. During an informal disciplinary hearing (either before an Initiating Officer or before the Informal Disciplinary Hearing Committee), the student must be provided with the following information:
3. Based on the findings of an informal hearing, the Initiating Officer or Informal Disciplinary Hearing Committee shall recommend in writing to the Vice Chancellor for Academic Affairs one of the following orders:

If the Vice Chancellor for Academic Affairs enters an initial order imposing a sanction and exceptional circumstances as defined in WAC 478-120-100(3)(b)(i) exist, the matter shall be referred directly by the Vice Chancellor for Academic Affairs to the Faculty Appeal Board and the student shall be informed that he or she has the right to request a formal hearing according to the procedures set forth in WAC 478-120-075(3).
5. If the Vice Chancellor for Academic Affairs enters an initial order imposing a sanction but exceptional circumstances do not exist, then the student shall be informed that he or she has twenty-one calendar days from the date of the order (or twenty-five calendar days from the date of the mailing of the sanction) to request a hearing before the University Disciplinary Committee as noted in WAC 478-120-075 (1). If the student chooses not to appeal, the Vice Chancellor for Academic Affairs's order becomes the final order.
6. If, as a result of the Informal Hearing, a student who is already on Disciplinary Probation is judged to have committed the offense, the Vice Chancellor for Academic Affairs may refer the case to a more formal adjudicatory body managed on the Seattle campus (i.e., the University Disciplinary Committee or Faculty Appeal Board) for further review and consideration prior to the entry of an initial order.
7. Within 10-school days of the conclusion of the hearing and any associated investigations, the student shall be provided with a written order from the Vice Chancellor for Academic Affairs or his or her designate, which shall include a statement of the decision, the reasons for the decision, and information about appealing the decision. No unfavorable action may be taken against the student until the student has been given such notice and information. In a case involving an alleged sexual offense, notification of the outcome of that hearing shall be provided in accordance with the provisions of the federal Family Educational Rights and Privacy Act (FERPA) and its implementing regulations.
8. A student may request a hearing by the University Disciplinary Committee at any time during these informal proceedings. If such a request is made, the matter shall be referred directly to the University Disciplinary Committee and the informal hearing process described herein shall terminate.
9. The official record of the informal hearing shall consist of all documents prepared or considered by the Vice Chancellor for Academic Affairs or his or her designee.
